2. Customer access requirements
To deliver service, customers must provide reasonable access to needed business systems.
- Website, domain, hosting, CRM, ad account, and analytics access may be required
- Business details, service areas, offers, and workflow requirements should be accurate
- Approvals, feedback, and assets should be provided on the agreed timeline
3. Existing systems
Existing websites, software tools, data quality, ad accounts, tracking, and integrations may affect scope, schedule, performance, and implementation requirements.
4. Estimates, scope & changes
- Estimates are based on the scope discussed at the time.
- Third-party tools, ad spend, software subscriptions, or data migration may affect cost.
- Changes requested after approval may require written scope approval.
5. Damage & liability
We take reasonable care while working in customer systems. We are not responsible for pre-existing technical issues, third-party platform outages, ad platform decisions, or delays caused by factors outside our control.
6. Payments
Payment terms are defined in the project proposal or invoice. Late payments may pause scheduling, material ordering, or active work.
7. Cancellations & termination
Project cancellation terms depend on the approved scope, materials ordered, and work already performed. We reserve the right to refuse or terminate service for unsafe conditions, non-payment, harassment, or unlawful requests.
8. Limitation of liability
To the fullest extent permitted by law, JAX Agency shall not be liable for indirect, incidental, or consequential damages.
9. Governing law
These Terms are governed by applicable United States law unless otherwise agreed in writing.
